If you were catastrophically injured and are unable to establish fault of another driver, you can claim for Catastrophic Injuries Support.

 

The Catastrophic Injuries Support (CIS) scheme provides lifetime treatment, care and support for people catastrophically injured in motor vehicle crashes in Western Australia who are unable to establish fault of another driver.

 

The treatment, care and support needs of a person are the needs of the person for or in connection with any of the following —

 

• medical treatment (including pharmaceuticals);

• dental treatment;

• rehabilitation;

• ambulance transportation;

• respite care;

• domestic assistance;

• attendant care services;

• aids and appliances;

• prostheses;

• education and vocational training;

• home and transport modification;

• any other kinds of treatment, care, support or services that are approved by the Insurance Commission of Western Australia (either generally, for specified classes of cases, or for a particular person).

 

You would not be entitled to a payment for general damages (pain and suffering and other non-pecuniary losses) in the circumstances where you are unable to establish the fault of another person for the accident.
